Terms & Conditions
These Terms and Conditions are in two parts. Part A (Website Terms of Use) applies to everyone who visits www.odysseydmc.com. Part B (Booking and Services Terms) applies when you book or receive services from Odyssey DMC, a company registered in the United Arab Emirates, trade licence no. 235080, with its office at Office No: 311, Third Floor, Latifa Tower, Sh. Zayed Road, Dubai, UAE.
Please read them carefully. By using our website you accept Part A. By confirming a booking, or by making payment, you accept Part B.
Part A: Website Terms of Use
1. Using our website
You may use our website for lawful purposes only, to learn about our services, make enquiries, and request bookings. You must not:
• Use the site in a way that breaks any applicable law or infringes anyone's rights
• Attempt to gain unauthorised access to our systems, or introduce viruses, malware, or harmful code
• Scrape, copy, or harvest content, rates, or contact details by automated means without our written permission
• Submit false, misleading, or fraudulent information, or impersonate another person or company
2. Accuracy of information
We take care to keep our website accurate and current, but itineraries, rates, availability, opening times, and descriptions may change without notice. Nothing on the site is a binding offer. A price or itinerary is confirmed only when we issue a written quotation or booking confirmation under Part B.
3. Intellectual property
All content on this website, including text, photographs, video, logos, brand names, designs, and software, belongs to us or our licensors and is protected by intellectual property law. You may view and print pages for your personal or internal business use. You may not reproduce, distribute, modify, or commercially use any content without our prior written consent.
4. Third-party links and content
Our website may link to third-party sites, such as hotels, attractions, booking platforms, and social media. We do not control those sites and are not responsible for their content, availability, or practices. A link is not an endorsement.
5. Enquiries and submissions
Information you send us through forms, email, or chat must be accurate and lawful. We handle personal data as described in our Privacy Policy [https://www.odysseydmc.com/privacy]. Sending an enquiry does not create a booking or a contract.
6. Disclaimers and limits of liability for the website
The website is provided "as is" and "as available". We do not guarantee it will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we are not liable for loss arising from your use of, or inability to use, the website, or from reliance on its content. Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by our negligence.
7. Changes and suspension
We may update the website, these terms, or any part of our services at any time. The version published on the site when you use it or make a booking applies. We may suspend or restrict access to the site without notice for maintenance, security, or other reasons.
Part B: Booking and Services Terms
8. Who these terms apply to
Part B applies to bookings made directly with us by individuals, families, and corporate clients ("you" or the "lead guest", who books on behalf of everyone in the travelling party), and, except where a separate written agreement says otherwise, to bookings made through travel agents and tour operators ("Trade Partners"). The lead guest confirms they are authorised to accept these terms for all members of the party and must make sure each member is informed of them.
9. Quotations and bookings
• A quotation is valid for the period stated on it, and is subject to availability at the time of booking.
• A booking is confirmed only when we issue a written booking confirmation and receive the deposit or payment required by it.
• Please check the confirmation carefully, including names (which must match passports), dates, and services, and tell us of any error immediately to avoid penalties that maybe imposed by our suppliers.
• Our services are limited to those listed in the confirmation. Anything not listed, such as international flights, visas, insurance, tips, and personal expenses, is not included.
10. Prices and payment
• Prices are quoted in AED or USD and include applicable taxes, including UAE VAT and tourism-related fees, unless stated otherwise.
• A deposit of 50% is due to confirm a booking, and the balance due will be stated in your confirmation.
• Payment may be made by bank transfer or payment link. Any bank charges are your responsibility.
• If payment is not received on time, we may cancel the booking and apply the cancellation charges in Section 12.
• Rates may change before confirmation due to currency movements, supplier price changes, fuel, government fees, or taxes. Once confirmed, prices will not be increased except where the increase results from a change in government fees or taxes, or from changes you request.
11. Changes requested by you
Please tell us in writing as soon as possible if you want to change dates, services, or names. We will try to accommodate changes, subject to supplier availability. Changes may incur supplier charges and a price difference. If a change cannot be made, the cancellation terms in Section 12 apply.
12. Cancellation by you
Cancellations must be sent to us in writing. They take effect on the date we receive them during business hours. Unless your confirmation states different terms, the following charges apply booking price:
• Some services, such as peak-season hotels, group bookings, special events, and third-party tickets, carry stricter supplier terms. We will tell you of any non-refundable or non-changeable elements before you confirm.
• Refunds, where due, are paid to the original payment method within 30 days, less any non-recoverable bank or processing charges.
• Unused or partly used services, early departures, and missed transfers or activities caused by you are not refundable.
13. Changes and cancellation by us
We may need to change or cancel services because of supplier issues, weather, safety, government restrictions, or events outside our control. If we make a significant change or cancel, we will tell you as soon as reasonably possible and offer, where practicable, a comparable alternative or a refund of amounts paid for the affected services. Beyond that, we are not liable for further costs, except where required by law.
14. Guest responsibilities
• Travel documents: You are responsible for valid passports (normally at least six months' validity from arrival), visas, entry requirements, and health documentation. We can assist with visa applications where agreed, but we do not guarantee approval.
• Insurance: We strongly recommend comprehensive travel insurance covering medical care, repatriation, cancellation, and personal belongings. We may require proof of insurance for certain activities.
• Accurate information: You must tell us before booking about any medical conditions, pregnancy, mobility limits, dietary needs, or other requirements that may affect your trip. We cannot be responsible for issues arising from information not disclosed.
• Local laws and customs: You must obey UAE and local laws and respect local customs, dress codes, and religious practices. Guests are responsible for the legal consequences of their own conduct. This includes rules on alcohol, drugs and controlled medication, photography, drones, and public behaviour.
• Conduct: We and our suppliers may refuse or end service, without refund, to any guest whose behaviour is unsafe, unlawful, abusive, or disruptive, or who is under the influence of alcohol or drugs.
• Timekeeping: Please be ready at pick-up points at the agreed times. We are not responsible for missed services caused by late arrival.
15. Health, safety, and activities
Some of our services, including desert safaris, dune driving, camel rides, quad biking, overnight camping, water activities, and other outdoor experiences, involve inherent risks, and dune driving involves rough terrain and sudden movement.
• Guests must follow the instructions of our drivers, guides, and staff, and use the safety equipment provided.
• Some activities are not suitable for pregnant guests, young children, or people with back, neck, heart, or mobility conditions. Age, height, and weight limits may apply, and we may decline participation for safety reasons without refund.
• Guests take part at their own risk, and parents or guardians are responsible for the supervision of children at all times.
• We maintain our vehicles and equipment and use licensed drivers and guides in line with applicable regulations. We do not guarantee any activity will be free from risk.
• In an emergency, we may take reasonable steps to protect your safety, including arranging medical care or evacuation, and the resulting costs are your responsibility unless covered by insurance.
16. Third-party suppliers
We arrange services from independent hotels, transport operators, airlines, activity providers, and other suppliers. Those suppliers are responsible for their own services, and their terms also apply to you. We select suppliers with reasonable care, but we are not liable for the acts or omissions of independent suppliers except as set out in Section 18 or where the law requires.
17. Force majeure
Neither party is liable for failure or delay in performing obligations where caused by events beyond its reasonable control. These include natural disasters, extreme weather, epidemics, war, armed conflict, terrorism, civil unrest, airspace or border closures, government orders or travel advisories, strikes, and utility or transport failures. Where such an event affects your booking, we will try to rebook or adjust services. Otherwise, we will refund amounts paid for services not delivered, less non-recoverable supplier costs and charges already incurred.
18. Our liability
• We will provide services with reasonable skill and care.
• If we fail to do so, our liability is limited to the direct loss you prove, and, to the fullest extent permitted by law, to the total price paid for the affected services.
• We are not liable for indirect or consequential loss, loss of enjoyment beyond what the law requires, loss of profit or business, or for loss of or damage to valuables, cash, or personal belongings, which you should insure.
• Nothing in these terms limits liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited, and nothing affects your mandatory rights as a consumer.
19. Complaints
If a problem arises during your trip, tell your guide or our operations team immediately, on 24-hour contact number +971 04 512 5224, so we can try to fix it on the spot. After your trip, you may contact your Tour Operator as per their complaint's procedure.
20. Additional terms for Trade Partners
• Trade Partners act as principal or as agent for their clients, as agreed in writing, and are responsible for making these terms available to their clients.
• Contracted rates are net, confidential, and valid for the stated period. Payment terms, credit limits, and cancellation schedules in a signed rate agreement or contract prevail over Part B.
• Trade Partners must provide complete and accurate guest details in time for us to deliver services, and must comply with applicable data protection law when sharing personal data with us.
• Trade Partners must not misrepresent our services, or make commitments on our behalf, without our written approval.
21. Privacy
We handle personal data in line with our Privacy Policy [https://www.odysseydmc.com/privacy]. By providing personal data of other guests, you confirm you are entitled to do so.
22. Governing law and disputes
These terms, and any dispute arising from them or from our services, are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. We encourage you to contact us first so we can try to resolve any issue amicably. Nothing here removes any right you have to bring a claim before the courts or authorities of your home country where mandatory consumer law gives you that right.
23. General
• Entire agreement: These terms, together with your booking confirmation, are the whole agreement between us and replace earlier discussions.
• Changes: We may update these terms. The version in force at the time of your booking confirmation applies to that booking.
• Severability: If any provision is found unenforceable, the rest remain in effect.
• No waiver: Failure to enforce a right is not a waiver of it.
• Assignment: You may not transfer your booking or these terms without our consent. We may assign ours to an affiliate or successor.
• Language: The English version prevails over any translation.
• Third parties: Only the parties to a booking may enforce these terms, except where they expressly benefit our suppliers or staff.
